In North Carolina, it is illegal to drive under the influence of controlled substances such as cocaine, heroin, marijuana or certain prescription medications. Driving under the influence of drugs, or drugged driving, is punishable similar to a DUI/DWI charge. But there are important differences.

  • First, that you had drugs in your system.
  • Second, that the drugs you ingested caused you to be impaired.

Proving drugs were in your system is harder than measuring the amount of alcohol in your system. Even harder is proving drugs caused an impairment. Often times, the prosecution can't meet its burden of proof.

The state will often have a police officer testify as a drug recognition expert (DRE). You need an experienced attorney to show that the signs of impairment the DRE is claiming could only come from drugs, could actually have come from other sources, such as an injury or other medical condition.
